HC directed to stop further encrochment within Buriganga river at Chormirerbagh and operate Mobile Court

High Court directed to conduct a mobile court under the provisions of law of প্রাকৃতিক জলাধার সংরক্ষন আইন and Environment Conservation Act 1995 at Mirerbag of Keranigonj, Dhaka.


Following a writ petition filed by Human Rights and Peace for Bangladesh (HRPB) the High Court Division comprising of Mr. Justice Quazi Reja-ul Hoque and Mr. Justice A.B.M. Altaf Hossain was pleased to issue a Rule Nisi calling upon the Respondents to show cause as to why encroachment of the territory of river Buriganga at Char Mirerbagh opposite to Farashgonj Ghat, South Keranigonj, Dhaka, should not be declared illegal and without lawful authority as it is violative of the provisions of law and Judgment passed on 25.06.2009 by the Hon’ble High Court Division in Writ Petition No. 3503 of 2009 and Why a direction should not be given upon the respondents to remove all the earth filling, temporary and permanent structures as made in the river Buriganga at Char Mirerbagh opposite to Farashgonj Ghat, South Keranigonj, Dhaka.

Their Lordships also passed following ad-interim order;-

a) Pending hearing of the rule Direct the respondent no. 3 and 7-9 to stop all further encroachment/earth filling within the territory of river Buriganga and all kinds of constructions work at Char Mirerbagh, opposite to Farashgonj Ghat, South Keranigonj, Dhaka with 48 hours and file a compliance report before this court within 2 weeks.

b) Pending hearing of the rule direct the respondent no. 3-5 to conduct a mobile court under the provisions of law at Char Mirerbagh, opposite to Farashgonj Ghat, South Keranigonj, Dhaka, who has violated the provision of প্রাকৃতিক জলাধার সংরক্ষন আইন , 2000 and Environment Conservation Act 1995 (amended in 2000 and 2002) .

The petitioner is Advocate Asaduzzaman Siddique and respondents are the Secretary, Ministry of Shipping, Ministry of Industries, The Chairman, BIWTA, The Director General, Department of Environment, The Director, Enforcement, Department of Environment, The Police Commissioner, Dhaka Metropolitan Police, The Director (Port and Traffic), BIWTA, The Deputy Commissioner, Dhaka, The Officer in Charge (O.C), Keranigonj Thana,.
