High Court Directed to maintain statuesque in respect of any further construction on the land in Brahmanchiron Graveyard situated in Dholpur, P.S Sutrapur, Dhaka. ------------------------------------------------------------------------------------------

\r\nA public interest litigation was filled by Human Rights And Peace For Bangladesh challenging inaction of the respondents to stop encroachment of the land of Brahmanchiron Graveyard, Dholpur, Dhaka.

\r\n
\r\nAfter hearing the parties the Hon’ble High Court Division comprising of Mr. Justice Quazi Reza Ul Huq and Mr. Justice A.B.M. Altaf Hossain was pleased to issue Rule Nisi calling upon the Respondents to show cause as to why the constructions on the land situated in Brahmanchiron Graveyard, Dholpur, Dhaka, should not be declared illegal and without lawful authority and why a direction should not be given upon the respondents to demolish/evict the constructions built on the graveyard land and why a direction should not be given upon the respondents to protect and maintain the Brahmanchiron Graveyard as per the plan of the Dhaka City corporation..

\r\nTheir Lordships also passed the following ad-interim order;-

\r\ni) Pending hearing of the rule directs the respondents to maintain statuesque in respect of any further construction on the land in Brahmanchiron Graveyard situated in Dholpur, P.S Sutrapur, Dhaka and direct the respondent no. 2 and 7 to take all steps to maintain statuesque in respect of further construction and file a compliance report before this court within 3 weeks.

\r\nii) Pending hearing of the rule directs the respondent no. 2 and 4 to submit the relevant papers/document and plan of the Dhaka South City Corporation of the Brahmanchiron Graveyard situated in Dholpur, P.S Sutrapur, Dhaka, within 3(three) weeks before this court.

\r\nThe petitioners are Advocate Asaduzzaman Siddiqui. Respondents are the the Secretary, Ministry of L.G.R.D, The Administrator, Dhaka City Corporation, The Chief Executive Officer (CEO), The Chief Engineer (Planning), The Revenue Officer, Dhaka City Corporation, The Deputy Commissioner of Dhaka, The Officer in Charge, Sutrapur.
